Terms and Conditions

Our tours are a great introduction to Australian nature & wildernesses areas and are adventure learning journeys where our intention includes maximising enjoyment for all and engaging with the wonder of nature, and the places we visit, and the people we meet.

On our extended some journeys, we require permits to enter Aboriginal traditional and protected areas. We are travelling some routes that have been travelled for many thousands of years, and aim to remain flexible to maximise the experience for all, respecting local customs and protocols.
Always, our intention is to deliver great value for you – this is your journey. You are invited to share your intentions and objectives in joining us. This will provide clarity for you and will help us, and the people and communities we connect with to better deliver what you want.

SPIRIT SAFARIS – RETAIL TERMS & CONDITIONS

Valid from 1 March 2026

  1. THE AGREEMENT

By booking a tour with Spirit Safaris (“the Operator”), you (“the Traveler” or “Client”) agree to be bound by these Terms and Conditions. These terms constitute the entire agreement between the Operator and the Client.

  1. OPERATIONAL VARIATIONS & ITINERARY

2.1 The Operator reserves the right to vary, alter, or cancel tours or any part thereof due to extreme weather, road conditions, safety concerns, supplier availability, or other unforeseen circumstances to ensure the safety and operational integrity of the tour.

2.2 Every effort will be made to adhere to published itineraries and departure times; however, no guarantee is given. No compensation, refund, or credit shall be payable for variations, delays, or missed connections beyond the Operator’s control.

2.3 The Operator reserves the right to substitute vehicles, guides, accommodation, or other services of a similar standard where necessary.

3. PRICING, PAYMENTS & FUEL SURCHARGES

3.1 All prices are in Australian Dollars (AUD) and include GST unless otherwise stated. Prices are subject to change prior to booking confirmation. Once confirmed, your booking price is fixed except where surcharges apply under clause 3.4.3.4 Fuel Price Adjustment (Surcharge)

3.2 Tour pricing is based on an average diesel fuel price of AUD $1.80 per litre in Sydney NSW as at 1 March 2026. Price is published by Australian Institute of Petroleum https://www.aip.com.au/pricing/Diesel/NSW/NSW-State-Average

Due to the remote nature of operations, the Operator reserves the right to apply a fuel surcharge where diesel exceeds AUD $2.50 per litre.

Surcharge scale based on fuel price 14 days prior to departure:
• $2.50 – $2.80 → $35 per person / per tour day
• $2.80 – $3.10 → $55 per person / per tour day
• $3.10 – $3.40 → $75 per person / per tour day
• Above $3.40 → $95 per person / per tour day or pricing review

Where applicable:
• Advised in writing prior to final payment
• Applies to bookings not yet paid in full
• Clients may proceed or cancel (standard cancellation terms apply)

The Operator will make reasonable efforts to absorb increases up to $2.50/L and reserves the right to review pricing for future departures where increases are substantial and sustained.

4. BOOKING, CANCELLATIONS AND REFUNDS

4.1 Written Notice: Cancellations and variations must be received in writing. The cancellation date is the date the Operator receives notice during Australian Eastern Time (AET or AEST in Summer) business hours (9:00 AM – 5:00 PM).

4.2 Booking & Cancellation Terms
Payments – A $500 per person deposit is required to secure your booking. Final payment is due 120 days prior to departure. Bookings made within 120 days require full payment at time of booking.
Amendments – Changes are permitted up to 61 days prior to departure (subject to availability). Fees may apply.

Cancellations (by customer)
• 120+ days: deposit forfeited
• 61–119 days: 50% forfeited
• ≤60 days: 100% forfeited

Amendments: permitted up to 61 days (fees may apply)

Cancellation by Spirit Safaris – If we cancel your tour, you will be offered:
• Full refund, or
• Alternative tour, or
• Travel credit

4.3 No refunds are available for unused services, early departure from tour, or failure to join a tour.

Travel insurance is highly recommended

5 REMOTE AREA TRAVEL & RISK ACKNOWLEDGEMENT

5.1 The Client acknowledges that travel in remote Australian regions involves inherent risks including:

  • Rough terrain
  • Extreme temperatures
  • Limited medical access
  • Wildlife encounters

These risks may result in injury, illness, or death.

5.2 A signed waiver may be required prior to travel.

  1. LIMITATION OF LIABILITY

6.1 Nothing in these terms excludes rights under the Australian Consumer Law (ACL).

6.2 To the maximum extent permitted by law, the Operator is not liable for:

  • Personal injury or illness
  • Loss or damage to property
  • Delays or disruptions

where such events are outside the Operator’s reasonable control.

6.3 The Operator is not responsible for acts or omissions of third-party suppliers.

  1. FORCE MAJEURE

The Operator is not liable for failure to perform due to events beyond reasonable control, including but not limited to:

  • Extreme weather events
  • Flooding, bushfires, cyclones
  • Pandemics or health emergencies
  • Government restrictions or border closures
  • Road closures or access limitations
  • Industrial disputes or civil unrest

Where such events occur:

  • The Operator may vary, postpone, or cancel tours
  • Credit, rescheduling, or partial refunds may be offered at the Operator’s discretion, subject to unrecoverable costs
  1. TRAVEL INSURANCE

Comprehensive travel insurance is strongly recommended at time of booking, covering:

  • Cancellation
  • Medical expenses
  • Travel delays
  • Loss of personal items
  1. CONDUCT & SAFETY

9.1 The Operator reserves the right to refuse or remove any passenger without refund where behaviour:

  • Endangers safety
  • Disrupts other guests
  • Breaches Australian law

9.2 Smoking and alcohol consumption are not permitted in vehicles or during certain tour activities.

  1. PHOTOGRAPHY & MARKETING

The Operator may use images taken during tours for promotional purposes unless the Client advises otherwise in writing.

  1. PRIVACY

Client information is used solely for booking and operational purposes and will not be shared except as required to deliver services.

  1. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia, and all parties submit to the jurisdiction of its courts.

COVID 19

REVISED TERMS AND CONDITIONS RE COVID – as from 22 May 2022

Due to now all borders being open in all Australian states, and Covid restrictions being relaxed, and self responsibility being encouraged by Australian governments, PLUS insurance being available for Covid cancellations, we are reverting to our pre Covid Terms and Conditions –  see below

Note if you cancel, or are delayed on your tour by Covid, we will not take responsibility for your associated costs of isolation, relocation etc. As always we highly recommend travel insurance.

Covid Travel Insurance is available for example at $49 for $4000 cover of isolation costs etc – see website here  –

We comply with COVID-19 compliance and cleaning conditions recommended by all states in which we operate.

Tailored tours are available for your family or group.  We operate tours from 2 -4 passengers in Toyota Landcruisers or for families up to 7. We also can combine vehicles for convoys or larger groups.
